iPhone forgetting playback position; resetting playback history

I have 2 frustrating issues with my iPhone and I'm interested if anyone else has had the same issues:

1) I would estimate about every 1 in 6 times I play a podcast or audiobook that I am part-way through, the iPhone snaps it back to the beginning, losing my spot.

2) sporadically, it marks podcasts I've listened to as unplayed (ie. blue dot appears) after I sync. At first I thought perhaps this was confusion caused by syncing multiple devices (AppleTV and iPod 5G), but it has happened again tonight despite the fact that neither of those devices have been synced in the last week, so that rules out that possibility.

given it's jailbroken and unlocked, I'm reluctant to restore the iPhone, so i was wondering if anyone has had similar experiences and knows how I might fix it. Or perhaps it used to happen but doesn't since updating to a new firmware (I'm running v1.1.1)? If I knew it would be fixed with a 1.1.2 or 1.1.3 update I might be more willing to take the plunge.
