Is this covered by warranty?

Hey there, I have a 2gb nano, which has been used for about 5 months. For the last month or two the soft rubber of the ear plugs has been deteriating in the same place on both ear plugs (it must be how they sit in my ears for some reason). During the last week it got alot worse and I dont think it will be long until all the rubber peels off. I thought apple would replace the ear phones since the nanos only 5 months old and this defiantly shouldnt happen but when I took it into an apple reseller/service store they said that they wont because its classed as usual 'wear and tear'. They told be I could go straight to apple and see if they had a different opinion. I thought I might ask you guys what you think before I decide to take it any further.

You can press further as long as you like...you never when persistence will pay off.

As for my personal opinion, you have "worn" these ear plugs out and you should replace them with new ones.
