Question random insufficient privileges to rename

the designers (Mac Pros running OSX 10.4.11) here are experiencing random error messages when trying to rename folders on our Windows 2003 file server which they connect to via AFP.
It is a very inconsistent error message which reads ' you have insufficient prviliges to rename the folder xxx', however, when you OK the error message and try renaming again, it lets you rename it OK.
All the designers have seen this error message at some point or another but it's quite random and inconsistent.

It has been suggested to me that the error occurs because a file or files within the folder are open so as soon as you attempt to rename the folder, it's in effect changing the path. Has anybody else had any experience of this and/or any confirmation of suggestions for the problem ?

We don't use SMB, only SMB for the fear of what the SMB protocol will do to our files.
All our OSX Mac users connect to the shares which are shared by SFM, using AFP.
