How do I determine if the person selling it has indeed never used it? Things can be shrink wrapped after being opened. I could look at their feedback I supose. Any other suggestions?

Also, there isn't any shrinkwrap associated with Apple software releases. Only paper products, including the box.

I thought that the Apple agreement states that the software is only for one computer for one person. Once its been installed isn't it "illegal" to sell again? If so, I thought that if I can assure myself that it has never been installed I'll have a legit copy at a used price.

I suppose that's why eBay might not be the best place to buy it. And you might not be able to get verifiable feedback from the seller. Your only hopes: (1) buy from elsewhere; or (2) never register and never call Apple for support. Froogle leads me to several places with the retail price as low as $90.
