That would likely only happen if Preview was moved to another volume. Find Preview on your Mac, ensure it's in the main Applications folder where it belongs, and drag it back to the Dock if you prefer to keep it there. Drag the question mark out of the Dock as it serves no purpose.

That's normal behavior. The checkboxes are not exclusively for the purpose of iPod syncing. They've been there since before the iPod was born and are for general music activation. You can force an unchecked song to play but songs won't play in succession unless they're checked.
