What's the deal with discount software

I'm interested in picking up FileMaker 7 for my personal use at home. An eBay search for "FileMaker Pro 7" yields several discounted offerings, which are far less than the regular retail price of around $290.

The sellers I looked at usually have an insane positive feedback percentage, so I have no doubt I'll receive what I want... but how can they sell for so low? I know they don't come in a real box; it'd just be a CD-ROM and a code, but how can I be sure it's legitimate?
 
The vast majority of newer software on E-Bay is either:
  • Counterfit
  • Used

There are a few cases of legitimate software auction springing up from time to time, but a vast majority aren't. Another word of caution, the excesses "But I thought it was legit" or "The seller said it was legit" won't help if the offended company decided to sue. Best suggestion is buyer beware.
