iPod keeps jumping. HELP!

Hi, I was wondering if any one could help me with my ipod malfunction.
It's a 5th generation ipod nano.
i got it about a year and a half ago though didn't start using it until about 2 months ago, so it's fresh out of the box.
It seems to play fine most of the time though when i leave it to run without touching it for a few minutes the songs start jumping and jerking uncontrollably until i touch the wheel to make it stop. Really weird!
Any suggestions?

It won't let me, it says that the "iPod software update could not be contacted", but my internet connection is running fine.
 
Did you try to reset the iPod itself?

Cycle the "Lock" switch once from "Unlocked" to "Locked" to "Unlocked"
Hold the Center Button and the 12 o'clock position on the ClickWheel simultaneously for about 6 seconds.

The iPod should shut down and a silver Apple icon appears as the iPod resets. When done, try to play again. Does it do the same thing?
