Modem not recogning engaged signal

OS X internet dialer is not recognising the engaged tone when i dial my isp. This also happened in 9.1 but i thought it was a software problem but maybe there is something wrong with the modem. I think i have a latest firmware for it. Anyone else has this problem? or a way to fix it?

Well, there has definitely been a recent firmware update, but that is to enable you to use 56.Flex as well as V90 (I think).
Hmm, I'm not sure about this. If you are still under warranty, you may as well call Apple Support on 0870 6024831.
