I think this got added with OS X 10.1.3, but I can't be sure, because I confess that I don't use services as often as I should.
But on my system, the Services submenu only opens if you are in an application that has the ability to use Services. If you're in the Finder and you select the Services submenu, it just sits there. Same with AppleWorks. But in OmniWeb and TextEdit, the Service menu opens no matter if you have something selected or not (if something's not selected, everything will be greyed out, though).
This is a welcome improvement, but I think they could've just made the submenu greyed out if you're not in a Services-aware application instead of making it appear like the Services submenu is not working.
