strange iTunes ID3 tag error

I have a Blind Melon song called "Deserted". The genre listed in the ID3 tags is "Jam Bands". Of course, I disagreed and just labeled it "alternative". However, every time I would double-click on the song in the library or any playlist to play it, the genre would instantly revert back to "Jam Bands", and the song would instantly disappear from my smart playlist of "genre = alternative".

To prove this, I have uploaded the song file here:

This cannot be seen as illegal MP3 sharing, since there is an error with the file, and it is being used in an educational discussion. (Education, parody, etc. are legally free from copyright rules if used properly.) In this case, it is proper use to provide the entire song because this phenomenon only happens if the entire song is analyzed as is. I also own the Blind Melon CD.

Please let me know if anyone experiences this strange thing with the genre, and if so, is there anyway to fix it???
 
I would re-rip that song since you have the CD. It seems slightly corrupt. Two id3 tagging programs i downloaded do not recognize it as an mp3 file. When i play it in iTunes, it plays, but yes the Genre keeps changing. with iTunes i converted it to mp3, and that new file is fine...the genre 'stuck'. However, that is very lossy, i wouldn't recommend it. So just re-rip it.
 
Yeah, I know I could just re-rip it.

The main question I have is... why does it do that? And how would you be able to create an MP3 that has an unchangeable genre? Is that a feature or a bug? Maybe it is a "lock" ID3 tags option, and only a certain program can "unlock" it? Anyone know? Thanks!
