undeletable file

after removing the Photoshop CS2-Demo I still have the vietnamese EULA in my trash. The file is

/Users/<username>/.Trash/Adobe Photoshop CS2/Legal.localized/Ti?ng Viê?t.html

Emptying trash does nothing, deleting it with rm on console produces

rm: Ti?ng Viê?t.html: No such file or directory

but IT IS THERE! Wildcards or recursively deleting the containing directory also don't help...
