update mac os x 10.39 to 10.4

Mac OS X Tiger (10.4) is a full version release, so you will not be able to just "update" to it from Panther (10.39) - you will need to purchase 10.4
 
There are few places that still carry OS X 10.4. Apple doesn't carry it anymore. We Love Macs has it, at a premium price:

But be careful! You don't want an "upgrade" version. And if you go for a grey disk version (which is the version that comes with particular models of Mac), make sure that you get one that is specifically for *your* model of Mac.
