Article: Apple sues over leaked Tiger

I saw that thread, but didn't read every post.

Going entirely by the thread titles, "Info" and "actual products" would seem different things..
 
That's true... sometimes it is a bit difficult to dig through a thread to find a small mention of the topic. Better to have a new thread specifically covering the topic.

All I gotta say is "good for Apple." Their "edge" lies in their innovation, and if people are constantly updated on the progress of new and upcoming products, well, they just lose their "BAM!" when it's actually released.

Hell, if I worked as deep in Apple as those guys and held a position where I had access to pre-release builds of new software, I certainly wouldn't risk my damn job over trying to be the cool guy who introduces the world to something they shouldn't be introduced yet.

What do you think -- should breaking a legal NDA carry penalties as harsh as spamming? Do these people deserve big fines, or even jailtime?
 
They should be punished, though jail time seems excessive - prisons are full as it is.

Maybe they should spell out the penalties in the NDA - if they're not ready to pay the price, don't sign up.
 
Logging into my ADC Account today, I see that Apple has now posted a big, bold, red message at the top of the "Download Software" link:
PRE-RELEASE SOFTWARE IS APPLE CONFIDENTIAL INFORMATION. YOUR UNAUTHORIZED DISTRIBUTION OF PRE-RELEASE SOFTWARE OR DISCLOSURE OF INFORMATION RELATING TO PRE-RELEASE SOFTWARE (INCLUDING THE POSTING OF SCREEN SHOTS) MAY SUBJECT YOU TO BOTH CIVIL AND CRIMINAL LIABILITY AND RESULT IN IMMEDIATE TERMINATION OF YOUR ADC MEMBERSHIP.
 
A hefty fine would be better than sending them to jail. Large enough to hurt, but not that large as to bankrupt whoever broke the NDA.

does not really apply.

Its also very doubtful that if any loss can be
proven at all in this particular case.
