I don't want to delete it from the mac just from the dock. If I drag it off it reappears when I restart. It is not listed in any startup preference folders or in accounts login.
right-click on the App Store icon in your dock, then options.
Make sure nothing in options is checked. I suspect you'll see the Open at Login is checked.
