That is a feature, not a bug. It is to allow you to see the window behind it so you know it's there. IE does the same thing, although it positions new windows below and to the right of the old one. I'm not sure how you'd change this, except to set pages to open in new tabs instead of new windows.

There is a program that can fix this but I cant think of the name. I know there is one because I used it on my old iBook :p

I echo Arden, this is a great user feature in Safari, which stays consistent if you understand the operation. I'm not too sure what you need, but in Safari, if you resize the window, then the next window you open is that same size, and positioned to the right (and down if there's screen space) about one scroll bar's width (so you can still see part of the window behind it. If you use tabs, the window does not change in size or positon between tabs.
Resize the window you're on now, then open a new Window - same size!
Also the last window when closing will be the same size and position when re-opening Safari
I think I remember the software you are referring to. Safari in its original beta was flaky in windows positioning as I recall, but fixed later on.
What part about re-sizing windows does not work for you?

Part of the problem is, is that if you like windows to maximize screen real estate (like I do), then you don't want this to happen.

For starters, the "zoom" button only expands a window vertically, not horizontally (this is especially bad since this behavior is so inconsistant with other progs, which actually attempt to fill the entire screen space)

However, if you resize the window so that it fills up all the horizontal space as well, when you open up new windows, it shifts the new window about 15 pixels to the right - pushing the right side of the window off the screen. This makes using the window impossible, and you HAVE to re-position the window. Every time.

This is true in Safari 1.0. I don't recall if this was still true in the 1.1 that came with Panther 7b28 or not. However, minor little interface things like this have such a major impact...

Sometimes I forget that not everyone sees things from MY point of view. I am used to leaving about an inch of space on the right side, and leave the window sized to full vertical, top-to-bottom, and use tabs, so I don't struggle with moving windows very often, most sites have all the info that I want to see in that set area (except for advert banners and the like, which I don't care to view, anyway) I rarely use the zoom button, and rely on the resize corner for my needs, but I realize that may not be adequate for some.
Some apps would become really too complex if the authors allowed for every possible feature the user might want.

I'm also definitely a tab user, but I like having the scroll bar up at the right hand of the screen because 1) I wants as much useful screen area as possible, and 2) I can drag my cursor over to the right-most edge of the screen and click+drag to scroll around. I don't have to be terribly accurate in this case (in your case, I'd be constantly "missing" and accidentally clicking on a background window or desktop)

Remember, though, that when the zoom button works correctly, it makes the window as big as it needs to be to show all the content, unlike Windows which fills the entire screen. There are advantages to that, but I prefer to be able to see stuff behind the frontmost window.

Internet Explorer changes the size and position of windows with every new one, and it remembers the size of the window you just closed, which is annoying for certain popups. But when I have multiple windows open, they stack neatly and resize to the same spot, so I can see exactly what's open.

What, no scroll wheel? I don't miss the scroll bar too often, because I generally scroll from the mouse wheel, and so there's a little less movement of the mouse! :D
